Labeling
- Thermostats, thermometers, switches, lamps, medical or scientific instruments or electric relays. No label for batteries, products containing batteries and lamps, and cars. Lamp Wholesalers must provide information on spent lamp management.
Product Ban
- Thermometers sold by prescription only, except those with button cells, thermostats, measuring devices, and switches and relays (except replacement switches) although the manufacturer can apply for an exemption. Button cell batteries as of December 31, 2011. Phase out date for silver oxide button cells applies only to those marked SR357, SR364, SR371, SR377 or SR395. All other silver oxides may be sold until January 1, 2015.
Manufacturer Collection/Recycle
- Manufacturers of mercury-added lamps sold or distributed for household use in the state on or after January 1, 2001 must (individually or collectively) implement a department approved recycling program. Plans must be approved by the Maine DEP. After April 1, 2011, a manufacturer not in compliance with this provision is prohibited from selling or distributing any mercury-added lamp in the State.
- Auto manufacturers must collect motor vehicle switches.
- Manufacturers who sold mercury-switch thermostats in the state must establish and maintain a recycling program. The program must contain a system of financial incentives, approved by state regulatory officials, paid to both contractors and homeowners to encourage recycling of mercury thermostats.
